1. Agreement to Terms

Welcome to BAAM (“Service”), operated by Achilles One LLC, a Wyoming limited liability company (“Company,” “we,” “our,” or “us”).

By accessing or using BAAM, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use BAAM.

2. Description of Service

BAAM is an AI-assisted prospecting and outreach platform designed to help professionals identify potential business opportunities and manage outbound communication.

BAAM may provide the following features:

• Identification of potential clients based on publicly available buying signals

• Delivery of qualified prospects to your account

• AI-assisted generation of outreach message drafts

• User-initiated email sending through a connected Gmail account

• Tracking of companies designated as “Dream Clients”

BAAM is designed for creative freelancers, agencies, and professionals seeking new business opportunities.

3. Account Registration and Eligibility

3.1 Eligibility

You must be at least 18 years old to use BAAM. By creating an account, you represent that:

• You are at least 18 years of age

• You have the legal capacity to enter into these Terms

• You will provide accurate and complete information

3.2 Account Creation

To use BAAM, you must:

• Create an account using a valid email address

• Choose a secure password

• Provide valid billing information

• Connect your Gmail account via OAuth to enable email sending features

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials

• All activities that occur under your account

• Promptly notifying us of any unauthorized use

We are not responsible for losses resulting from unauthorized access caused by your failure to secure your account.

4. Subscription and Payment

4.1 Subscription Plan

• Price: $250 USD per month

• Billing: Monthly, recurring

• Trial: 7-day free trial for new users

4.2 Free Trial

• Credit card required to begin trial

• No charge during the 7-day trial

• Full access to features during the trial

• Subscription begins automatically on day 8 unless canceled

Limitations:

• One trial per email address

• One trial per payment method

• We reserve the right to deny trials in cases of suspected abuse

4.3 Billing and Payment

• Payments are processed via Stripe

• Subscriptions are billed monthly in advance

• All prices are in USD

• Fees are non-refundable except as described below

4.4 Refund Policy

15-Day Money-Back Guarantee

• Applies to your first paid month only

• Must be requested within 15 days of initial charge

Subsequent months are non-refundable.

4.5 Failed Payments

If payment fails:

• We may retry payment up to three times

• You will receive notification

• Access may be suspended after 7 days

• Account may be terminated after 30 days of non-payment

5. Cancellation and Termination

5.1 Cancellation by You

You may cancel at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period.

5.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms

• Use BAAM for illegal or abusive purposes

• Engage in spam or misuse

• Fail to pay outstanding fees

5.3 Effect of Termination

Upon termination:

• Your access to BAAM will cease

• Gmail access will be revoked

• Data may be deleted within 30 days

• Outstanding fees remain payable

6. Acceptable Use Policy

6.1 Permitted Use

You may use BAAM for lawful business outreach and relationship-building purposes.

6.2 Prohibited Use

You may not use BAAM to:

• Send spam or unsolicited bulk emails

• Harass or deceive recipients

• Violate CAN-SPAM or similar laws

• Circumvent usage limits

• Scrape or export prospect data in bulk

• Reverse engineer the Service

7. AI-Generated Content

7.1 AI Assistance

BAAM may generate message drafts using AI technology. These drafts are suggestions only.

You are responsible for reviewing, approving, and sending all messages.

7.2 Responsibility

You acknowledge that:

• AI output may contain errors

• BAAM does not guarantee effectiveness or accuracy

• You are responsible for compliance with applicable laws

8. Gmail Integration

8.1 Authorization

By connecting your Gmail account, you authorize BAAM to:

• Send emails only when you explicitly initiate sending actions

• Access Gmail in read-only mode to display conversation threads and detect replies for emails sent through BAAM

• Store encrypted OAuth tokens solely to maintain the connection

BAAM does not scan inboxes, read unrelated emails, or modify inbox state (including labeling, archiving, deleting, or marking messages read/unread).

8.2 Revocation

You may revoke Gmail access at any time through:

• Your BAAM account settings

• Your Google Account permissions

Revoking access disables email features.

8.3 Google API Compliance

BAAM’s use of Gmail data complies with the Google API Services User Data Policy, including Limited Use requirements.

9. Intellectual Property

All BAAM software, branding, and proprietary materials are owned by Achilles One LLC and protected by applicable intellectual property laws.

You retain ownership of content you provide, subject to a limited license allowing us to operate the Service.

10. Prospect Data and Accuracy

BAAM uses publicly available data sources. We do not guarantee accuracy, completeness, or outcomes.

You are responsible for verifying information and exercising professional judgment.

11. Disclaimers

BAAM is provided “AS IS” and “AS AVAILABLE.”
We make no guarantees regarding results, revenue, or responses.

12. Limitation of Liability

To the maximum extent permitted by law, Achilles One LLC shall not be liable for indirect, incidental, or consequential damages.

Our total liability shall not exceed the amount paid by you in the prior 12 months or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Achilles One LLC from claims arising from your use of BAAM or violation of these Terms.

14. Third-Party Services

BAAM integrates with:

• Google (Gmail OAuth)

• OpenAI (AI-generated content)

• Stripe (payments)

Your use of third-party services is subject to their respective terms.

15. Privacy

Your use of BAAM is governed by our Privacy Policy, available at baam.one/privacy.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Any dispute shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.

17. Changes to Terms

We may update these Terms from time to time. Continued use of BAAM constitutes acceptance of revised Terms.
